You agree to use the Website in compliance with all applicable laws and regulations, including those related to A2P (Application-to-Person) messaging and Meta Ads policies. If you are a Patient, you also agree to comply with the terms set forth in Section 12 (Terms Applicable to Patients).

4. A2P Messaging Compliance

If you use our messaging services, you agree to comply with A2P 10DLC messaging regulations as outlined by the CTIA and The Campaign Registry (TCR), including but not limited to:

• Obtaining explicit user consent before sending SMS or MMS messages, using methods such as double opt-in (e.g., users confirm subscription by replying “YES” to a confirmation message).

• Not sending prohibited content, including but not limited to cannabis, hate speech, or misleading claims.

• Providing clear opt-in and opt-out instructions, including a response to “HELP” with brand contact information and an option to reply “STOP” to unsubscribe.

• Failure to comply may result in campaign rejection or suspension of messaging services.

5. Meta Ads Compliance

If you use our services in connection with Meta Ads (e.g., Facebook or Instagram advertising), you agree to adhere to Meta’s Advertising Policies, including:

• Providing accurate and truthful ad content, avoiding misleading or deceptive claims.

• Not promoting prohibited content, such as drugs, tobacco, or hate speech.

• Complying with Meta’s Community Standards and applicable data protection laws, including GDPR where relevant.

• Including a link to your privacy policy in lead generation ads and ensuring transparency about data usage.

• You must have a valid Facebook Business Manager account and ensure ads meet Meta’s technical requirements (e.g., image resolution of at least 1080×1080 pixels).

6. User Data and Privacy

Your use of the Website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Website, you consent to the collection and use of your information as described in the Privacy Policy. We are committed to protecting your personal information in accordance with applicable laws, including health information privacy laws where applicable.

7. Intellectual Property

All content on the Website, including text, images, and logos, is the property of Atlas Method or licensed to us. You may not use our content without prior written permission. You warrant that any content you submit does not infringe on third-party intellectual property rights.

8. Prohibited Conduct

9. Termination

We reserve the right to suspend or terminate your access to the Website at our sole discretion, without notice, for any reason, including but not limited to your violation of these Terms, Meta Ads policies, or A2P regulations. Upon termination, all rights granted to you under these Terms will cease immediately, and you must cease all use of the Website. Termination will not affect any rights or liabilities accrued prior to termination.

10. Limitation of Liability

To the fullest extent permitted by law, Atlas Method and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Website; (b) any conduct or content of any third party on the Website; or (c) unauthorized access, use, or alteration of your transmissions or content. In no event shall our aggregate liability for all claims relating to the Website exceed the amount you paid to us, if any, in the past six months for the services giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Website shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. 12. Terms Applicable to Patients

12.1 Scope of Services

Patients may receive a range of medical services provided by our licensed doctors, nurses, or advisors (“Practitioners”), including but not limited to:

• Hormone Therapy: Including hormone pellet therapy and other hormone-related treatments.

• Peptide Therapies: Administration of peptide-based treatments for various health conditions.

• Investigatory and Diagnostic Testing: Blood work, imaging, or other diagnostic procedures to assess health status.

• IV Supplements: Intravenous administration of vitamins, minerals, or other supplements.

• Weight Loss Programs: Customized plans, including medications, dietary guidance, or other interventions.

• Referrals to Medical Specialties: Recommendations or referrals to specialists for further evaluation or treatment.

• Lifestyle Advice: Guidance on diet, exercise, sleep, or other wellness practices to support overall health.

12.2 Billing Terms for Medical Services

• Total Cost: The cost for any medical service, including procedures, therapies, prescriptions, or consultations, will be determined at the time of service and is subject to future adjustments based on tariffs, pricing changes, or other factors. Patients will be notified of any changes in pricing.

• Payment Plan: Patients may opt for a payment plan consisting of three equal monthly payments, each equivalent to one-third of the total cost, subject to successful card payments.

• Payment Obligation: Upon initiation of any medical service, the Patient is liable for the full cost of the service. If the Patient discontinues the service or fails to complete the payment plan, the remaining balance becomes due immediately.

• Card Failure Policy: In the event of repeated card payment failures, we reserve the right to withdraw the monthly payment option and require the full cost of the service to be paid upfront.

12.3 Services Covered

The total cost of medical services may include, as applicable:

• Custom hormone pellets or other medications.

• Administration or insertion by qualified Practitioners.

• All necessary supplies and equipment.

• Required diagnostic testing, such as blood work.

• Clinical support during the treatment period.

• Consultations for lifestyle advice or referrals.

12.4 Patient Communication

• Patients may communicate with Practitioners in person, in writing, by SMS, or by phone call, as deemed appropriate by the Practitioner.

• All communications containing Protected Health Information (PHI) will be handled in compliance with applicable health privacy laws, including the Health Insurance Portability and Accountability Act (HIPAA).

• Patients are responsible for providing accurate contact information to ensure effective communication.

12.5 Additional Notes

• All payments are non-refundable once a medical service has been performed or initiated.

• Patients are responsible for ensuring that their payment information is accurate and up to date.

• Medical services are provided at the discretion of Practitioners, and not all services may be suitable for every Patient.

13. Changes to Terms

We may revise these Terms from time to time at our sole discretion. If we make material changes, we will notify you by posting the updated Terms on the Website and updating the effective date. Your continued use of the Website after the effective date of the revised Terms constitutes your acceptance of the changes.

14. Miscellaneous

14.1 Indemnification

You agree to indemnify, defend, and hold harmless Atlas Method, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Website, your violation of these Terms, or your infringement of any third-party rights.

14.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

14.3 Waiver

No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure by us to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

14.4 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published on the Website, constitute the entire agreement between you and Atlas Method regarding your use of the Website and supersede all prior agreements and understandings, whether written or oral.

14.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

14.6 Assignment

You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to any affiliate or in connection with a merger, acquisition, or sale of assets.

14.7 Notices

Any notices or other communications required or permitted under these Terms shall be in writing and delivered by email to the address you provided or by posting on the Website.
